Under the provision of the Registration Act, 1908, documents that are created to “create, declare, assign, limit or extinguish” any right, title or interest of the value of Rs 100 and upwards in an immovable property must be registered. Without registration, a buyer will not be able to claim his legal ownership of the said property in case disputes on the tile arise in future. However, this did not discourage about 12,000 naïve flat owners in Ghaziabad to take possession of flat from real estate developers. These buyers have paid the charges to the developers who have not done their part of the job.

It is worth mention here that one per cent of the property value has to be paid as registration charge, along with stamp duty. In case you buy a property for Rs 1 crore, you will be paying Rs 1 lakh in registration charges, along with a four per cent stamp duty.

According to media reports, the Ghaziabad District Administration (GDA) has sent notices to as many as 41 real estate developers for handing over units, primarily built under the Uttar Pradesh Awas Yojana across Vasundhara, Indirapuram and Loni, without registering them.

Asking the developers to register these properties at the earliest, the city stamps and registration department has stated that the evasion of the duty is causing revenue loss to the district administration.

Meanwhile in Greater Noida…

According to media reports, Greater Noida Authority Chief Executive Officer has directed its staff to keep the new office premises in Knowledge Park-4 free of executives that work for real estate developers are often found roaming in the office. The frequent visits to the office are made with an aim to keep developers updated with the policy changes and maintain cordial relationship with the staff in order to get work done quickly.

So far, there is no punishment that is pronounced for such “unauthorised” officials hobnobbing in the office. In the practice continues, legal action could be initiated against offenders.

It is worth mentioning here that the Greater Noida Authority Office allows public entry between 10 am and 12 pm. One needs prior permission of the senior officials to gain entry into the premises after this time. However, several unauthorised people hover around the office for the entire day, affecting and influencing work, say media reports.
