Gurgaon Going Tough Against Illegal Constructions. Is It, Really?

Those who had the good fortune to see Gurgaon grow in the past decade marvel at the inexorable speed at which the Millennium City expanded. Staring from the point where the new Gurgaon begins till about the Alwar district in Rajasthan (a large area of the city is part of the national capital region) , homes kept cropping up in what seemed like overnight to such spectators. Since India is infamous for its red tape worldwide, these constructions, at least a large part of it, were not done in compliance with the building laws. However, it is now that the state government and the district administration have started making quick notes, and taking hasty action.

In December last year, the Municipal Corporation of Gurgaon (MCG) on the directions of the Haryana government regularised 14 illegal colonies. Recently, the residents of these colonies were directed by the two authorities to submit their respective building plans by June or lose their property in sealing, forever this time.  Over the past decades, a large number of families have built their homes in these colonies, but are not able to enjoy civic amenities owing to the illegality of these structures.  

So, if you have property in Cancon Enclave Part 1 & 2, Vikas Nagar, Bhim Colony, areas along Tikri Village, Hari Nagar Extension Part 1 & 2, Ghasola Village, Shri Ram Colony, Naharpur Rupa, Devi Lal Extension, areas along Jharsa Village Extension, New Jyoti Park Colony, Surat Nagar Phase-1 Extension, Patel Nagar Extension and Shiv Nagar, you now have a chance to make it legal.

What must be noted here is the fact that Gurgaon falls under the Controlled Areas Act, which means unplanned development cannot take place in the city. According to officials, such constructions took place due to lack of information in the public sphere about that significant fact.

In the meantime, registry of plots, of course, illegally, has continued in the city. So much so that the Haryana chief minister in March ordered the city administration to scrutinise all sale deeds created in the past six months to check  their legal validity.

While suspending two block-level officials for allowing illegalities to take place, CM Manohar Lal Khattar ordered: “Submit a comprehensive report on the sale deeds issued in the last six months in all tehsils, and if they were issued in compliance with the rules or not.”

As a result of this, several real estate developers and individuals stand to lose their ownership on plots in areas, including Sohna, Farrukhnagar, Manesar, Pataudi and Gurgaon.
