Haryana Allows Registry of 4th Floors
In a slew of measures that would provide great relief to property owners in the state and give a boost to the real estate sector, the Haryana government has decided to allow registration of the fourth floors in a residential property beginning March 7.
While construction of the fourth floor was allowed in the state, property owners could not register this floor as a separate unit earlier, a cause of concern among property owners who have been demanding a change in guidelines.
Typically, a four-floor building consists of stilt parking and three floors.
“The government had allowed construction of a fourth floor, but disallowed its registration. Property owners have been demanding this be allowed. So I’ve directed concerned officials to allow registration,” Haryana Chief Minister Manohar Lal Khattar told media last year.
The Haryana Building Code, 2017, had been amended to implement the change and to bring uniformity in building bye-laws followed by development authorities across the state, Khattar had said in September last year.
The notification that was issued on March 8 in this regard, however, made it clear that no fragmentation of the space would be allowed. This means owners of all the floors will have to jointly register the property.
Under the new guidelines, the height of such structures has been capped at 16.5 metre. While no additional documentation would be required for buildings below 15 metre, structures surpassing that limit would have to receive a no-objection certificate (NOC) from the fire department to get a building plan approval.
On all new construction and buildings that need reconstruction providing stilt parking would be mandatory for the owners.
The Haryana government would reward those who adopt environment-friendly measures while building. Property owners who go solar and build solid-waste management plants would be allowed additional floor areas ratio.
