Making A Will? Keep These in Mind

You have all the right to divide all your hard-earned wealth according to your wish; the applicability of the law of inheritance will be rendered needless if you have created a will. What makes this whole legal exercise of your rights even more worthwhile is the fact that it is quite simple to create a will. However, before you start writing your will, here are certain points for you to consider:

Keep it simple and error free

Do not be afraid for you need not be familiar with legal jargon to write a will. A will written in a simple form in a language of your choice written on a plain piece of paper would do all it takes. We just have to be careful to ensure the words are fully conveying our intention and there is no scope left for interpretation. Also, there should not be correction marks here and there. This could turn the will invalid.

Disclose it all

A will is a legal instrument that gives you the freedom to distribute your property according to your wish. However, there are certain terms and conditions that have to be met in the way. To ensure that your will is not challenged in the court because there have been discrepancies in it, it is of utmost importance that you declare all your assets here. Any confusion in this regard will fail the whole purpose of creating the will.

Change of plan?

At one point in life you feel in a particular way, at another, the feelings might be contrary. So, you had decided to bestow upon your daughter all your personal wealth and had made a will accordingly. Now, you think differently. You could simply destroy the previous will and create a new one. If you had got your previous will registered, get it cancelled and get the new one registered. You can change your will as many times as you want, provided you keep destroying the previous one and follow the registration process. Also, under Section 18 of the Registration Act, you do not necessarily have to register your will.

At the end of it

Do keep in mind that your will comes into effect after the maker of the will passes away. As long as you live, things stand where they are.
